Birmingham Museums Trust Membership Terms and Conditions
Birmingham Museums Trust (BMT) is a registered charity (number 1147014) and a private limited company limited by guarantee (number 07737797), incorporated on 11 August 2011, and is governed by its Articles of Association (Articles).
The charity’s objects as set out in its Articles are:
To advance education by the operation, maintenance, development and promotion of museums, galleries and libraries in Birmingham, together with association facilities and related programmes of outreach and research, fostering knowledge and understanding, appreciation and enjoyment of the arts, history, science and technology by residents and visitors to the City of Birmingham.
In these terms and conditions, the following words have the following meanings:
Member means you and/or any other member of the Birmingham Museum Membership Scheme (depending on the context in which it is used). Please note that these terms and conditions apply to all members.
Membership Card means the card or cards provided to you by BMT confirming that you are a member.
Membership Fee means the money you have paid to BMT to become a member.
Membership Period means the date from which BMT receives your Membership Fee to the date on which your Membership expires. This will usually be 12 months from the date that we receive your Membership Fee. The term of your Membership Period is set out on your Membership Card.
During your time as a Member we will collect information about you to personalise your experience of Membership. We collect information about you in a variety of ways including, but not limited to:
- When you join as a Member;
- Each time you use your Membership Card(s) to visit exhibitions;
- When you make bookings for events;
- When you respond to BMT emails.
All information that you provide to BMT will be processed and held in accordance with the EU General Data Protection Regulation (GDPR) and all other applicable UK and EU law.
You agree that personal details provided to BMT may be used for administrative purposes to fulfil your membership rights and provide membership services to you.
You are responsible for informing us of changes to your personal details.
We may collect, use and share Aggregated Data, such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity.
Your Membership benefits
Your Birmingham Museums Membership gives you 12 months free entry to Thinktank, Birmingham Science Museum, Birmingham Museum & Art Gallery, Aston Hall, Blakesley Hall, the Museum Collection Centre, the Museum of the Jewellery Quarter, Sarehole Mill, Soho House, and Weoley Castle.
Cards are valid for one calendar year from date of purchase.
Membership gives you 10% off in all Birmingham Museums Trust cafés and shops including the Edwardian Tearooms. 10% discount is not available on designer jewellery at the Museum of the Jewellery Quarter. Cards must be shown at time of payment.
Membership does not include entry into all special events. Please check individual events for more information.
Membership does not include entry into all ticketed guided tours, talks, activities, or workshops at Birmingham Museum & Art Gallery.
Membership does not include free entry into ticketed talks, activities, or workshops at Aston Hall, Blakesley Hall, Museum of the Jewellery Quarter, Sarehole Mill, Soho House, Weoley Castle or the Museum Collection Centre.
Cards are for the use of the named person/persons only. Where 2 people are named, only 1 needs to be present. ID will be required on entry. For admission of free carers see Concessions Policy.
Only one card will be issued per membership. A replacement fee of £5 will be made for lost cards or cards requiring a new name.
Admission to all sites is subject to availability.
Day tickets for all Birmingham Museum Trust sites can be upgraded to a Membership within 30 days of the visit. This is only possible on production of a proof of purchase receipt or booking reference number.
Day tickets can only be upgraded to a Membership on a like for like basis. A maximum of 2 adult day tickets and 3 child/concession day tickets can be upgraded to a single Family Membership.
Tesco and Group On vouchers cannot be used to purchase Membership. Day tickets purchased at Thinktank by Tesco Vouchers cannot be upgraded to a Membership.
Upon purchase of a Membership you agree to take out your chosen Membership for one year. Refunds are not available under any circumstances. This does not affect your statutory rights.
Your Membership fee
Your Membership will renew annually. You will be charged at the end of the month, 12 months after the date your Membership started. Annual renewal will continue until you contact us on 0121 348 8263 or email BMAG.Enquiries@birminghammuseums.org.uk to opt out of your annual renewal.
You may opt out of annual renewal a minimum of 3 days after initially purchasing your Membership.
We will contact you shortly before the end of your Membership to let you know that your Membership will be due for renewal.
If you fail to pay Birmingham Museums Trust within 3 days of the renewal deadline you will be contacted and given the opportunity to pay the outstanding amount or cancel your Membership.
If you fail to pay this amount by the required date your Membership will immediately cancelled.
BMT reserves the right to terminate your Membership if in its reasonable opinion you behave in a way which is considered to be harassing, causing distress or inconvenience or you breach any of these terms and conditions.
Subject to any statutory right to cancel, your Membership Fee is non-refundable once payment has been received by BMT.
Membership rights are not transferrable.
Membership rights shall cease on a Member’s death or an individual ceasing to be a Member.
Publications and other materials
Unless stated otherwise, copyright and all other rights in all publications and materials supplied to you by BMT are owned by BMT. Members may not reproduce, transmit, distribute, sell or commercially exploit these materials without the prior written consent of BMT or to the extent expressly permitted by law.
Subject to clause 6.3 (see below), and to the extent possible by law, BMT excludes all liability to members or to any other third party for any loss of profit, or any special, incidental or consequential damages (however arising, including negligence) arising out of, or in connection with services, benefits and/or products supplied by BMT.
Subject to clause 6.3 (see below), the liability of BMT to you is limited to the amount of your annual membership fee.
Clause 6.3: Nothing in these terms and conditions excludes liability for death or personal injury caused by BMT’s negligence or for fraud or fraudulent misrepresentation.
Freedom of Information Act 2000 (“FOIA”)
BMT is a ‘Public Authority’ for the purposes of FOIA. Subject to certain exemptions, BMT may be required to release information to a third party upon request which may relate to the Membership Scheme.
BMT shall not be liable for any loss or damage that any member may suffer as a result of BMT’s disclosure of information under FOIA.
The obligations contained in this clause ('Freedom of Information Act 2000') shall remain in force notwithstanding the termination of this Agreement for any reason whatsoever.
